In the weeks that preceded his Listeria illness, Mr. Doyle Underwood, age 68, consumed cantaloupe on multiple occasions, including at least one Listeria-contaminated cantaloupe manufactured, distributed, and sold by the defendants. On or about September 2, 2011, Mr. Underwood developed fatigue, muscle aches, and mental status changes. Mr. Underwood’s condition worsened until he required hospitalization beginning on September 5, 2011. He remained hospitalized through October 3, 2011. While in the hospital, Mr. Underwood tested positive for Listeria. Mr. Underwood has been informed by Oklahoma health officials that his Listeria infection is associated with the multi-state outbreak linked to Jensen Farms and Frontera Produce.
